Welcome to beritajadul.com. These Terms of Service apply to everyone who visits our website, uses its features or places an order with us. Please read them carefully before you shop. By using beritajadul.com or placing an order, you agree to these terms. If you do not agree with them, please do not use our website.

beritajadul.com is an online shop for pet supplies, based in Dietzenbach, Germany. The shop is operated by the company registered at the Amtsgericht Offenbach am Main under HRB 56011, represented by its Managing Director Yunus Ilhan.

Throughout these terms, "we", "us" and "our" refer to beritajadul.com, and "you" refers to you as a visitor or customer.

You can find the current version of these terms on this page at any time. We may update them from time to time, for example when our services or the law change. The version that applies to your order is the one published at the time you placed it.

2. USING OUR WEBSITE

By using beritajadul.com and placing an order, you confirm that you are at least 18 years old or have the permission of a parent or legal guardian, and that you are legally able to enter into a binding contract.

You agree to use our website only for lawful purposes. In particular, you must not:

Attempt to hack, attack or disrupt the website or its servers.

Upload or send viruses or any other harmful code.

Post content that is abusive, offensive, defamatory or discriminatory.

Provide false or misleading information, including when placing an order.

Collect or track personal data of other users.

Interfere with or try to get around the security features of the website.

Infringe our intellectual property or that of anyone else.

If you break these rules, we may restrict or end your access to the website and take any further steps permitted by law.

3. PRIVACY

We take the protection of your personal data seriously. How we collect, use and store your data is explained in our Privacy Policy, which forms part of these terms. We only process your data in line with the General Data Protection Regulation (GDPR) and applicable German law.

4. PERSONAL USE OF PRODUCTS

Our products are sold to consumers for private, personal use. Orders that, in our reasonable judgment, appear to be placed by resellers or for commercial resale may be limited or declined.

Please always use our pet products as intended and follow any care, size or safety instructions provided with them. Keep an eye on your pet when they use a new toy, chew or accessory for the first time, and replace items that show signs of wear.

5. PRODUCT INFORMATION AND ACCURACY

We do our best to describe and show our products as accurately as possible. Even so, small mistakes in descriptions, prices, availability or delivery times can happen. If we notice an error, we will correct it as soon as possible. If an error affects an order you have already placed, we will contact you before going ahead and you can decide whether you still want the item.

Colours can look slightly different depending on your screen, and natural materials may vary a little from item to item. This does not count as a defect.

6. PRICES AND CHANGES

All prices on beritajadul.com are shown in euros (EUR) and include the applicable VAT. Shipping costs are shown separately before you complete your order.

We may change prices, products and promotions at any time. Price changes do not affect orders that have already been confirmed. We may also update, pause or remove parts of the website or individual products without notice.

7. PAYMENT

You can pay using the payment methods offered at checkout. When you enter your payment details, you confirm that you are authorised to use that payment method and that the information you provide is correct and complete.

Payments are processed by trusted external payment providers. We do not store your full card details ourselves.

We are not responsible for any fees your bank or card provider may charge. If a payment is reversed or charged back without a valid reason, we may contact you to arrange payment in another way.

8. PLACING AN ORDER AND CONCLUSION OF CONTRACT

The products shown on our website are not a legally binding offer, but an invitation for you to place an order.

When you click the order button at the end of checkout, you make a binding offer to buy the products in your basket. Right after that, you will receive an automatic email confirming that we have received your order. This email does not yet mean we have accepted your order.

The contract is concluded when we send you a separate email confirming dispatch, or when we ship the goods, whichever happens first.

We may decline an order, for example if an item is no longer available, if there is an obvious pricing error or if the delivery address is outside our delivery area. If we decline an order you have already paid for, we will refund the full amount to your original payment method without delay.

The contract language is English. We save the text of your order, and you will receive the details by email.

9. SHIPPING AND DELIVERY

We currently deliver to addresses in the Netherlands only. Orders are sent from our partner warehouses in Germany or France, depending on where the item is in stock.

You can choose between two shipping options at checkout:

FREE STANDARD SHIPPING

Cost: free of charge

Delivery time: 4 to 5 business days

INSURED EXPRESS SHIPPING

Cost: 4.95 EUR

Delivery time: 2 to 3 business days

Your parcel is insured against loss and damage while in transit.

Delivery times start once your order has been confirmed and payment has been received. Business days are Monday to Friday, excluding public holidays. The times given are estimates. Delays caused by the carrier, the weather, strikes or other events outside our control may occasionally happen, and we will keep you informed if we notice that your order is held up.

Please make sure your delivery address and phone number are correct and complete. We cannot be held responsible for delays or lost parcels caused by incorrect address details. If you spot a mistake after placing your order, please email us at info@beritajadul.com as soon as possible. We try our best to update orders, but if your parcel has already been sent we may not be able to change it.

If an order contains items from both of our warehouses, it may arrive in separate parcels. You will not pay any extra shipping for this.

10. DELIVERY CONFIRMATION AND TRANSFER OF RISK

The tracking or delivery confirmation provided by the carrier serves as proof of delivery. If your tracking shows a parcel as delivered but you have not received it, please contact us within 7 days so we can look into it with the carrier.

As you are a consumer, the risk of accidental loss or damage only passes to you once the goods have been handed over to you or to a person you have named to receive them.

11. RIGHT OF WITHDRAWAL, RETURNS AND REFUNDS

As a consumer in the European Union, you have the right to withdraw from your contract within 14 days without giving any reason.

The withdrawal period ends 14 days after the day on which you, or a person you have named who is not the carrier, receive the goods. If your order arrives in several parcels, the period begins on the day you receive the last parcel.

To use your right of withdrawal, please let us know with a clear statement, for example by email to info@beritajadul.com or by letter to our address above. You can use the model withdrawal form below, but you do not have to. To meet the deadline, it is enough to send your message before the withdrawal period has ended.

Consequences of withdrawal: If you withdraw from the contract, we will refund all payments we received from you, including standard delivery costs, within 14 days of receiving your withdrawal notice. We do not refund extra costs that result from choosing a type of delivery other than the cheapest standard delivery we offer, which means the 4.95 EUR for insured express shipping is not refunded. We will use the same payment method you used for your original purchase, unless we agree otherwise with you. You will not be charged any fees for the refund. We may hold back the refund until we have received the goods back or until you have shown proof that you have sent them, whichever happens first.

Please send the goods back to us without delay and no later than 14 days after you told us about your withdrawal. Before sending anything, please email us so we can give you the correct return address, as our goods are stored in partner warehouses. You will need to pay the direct cost of returning the goods. You only have to pay for any loss in value of the goods if this is caused by handling them in a way that was not necessary to check their nature, features and function.

Exclusions: The right of withdrawal does not apply to sealed goods that are not suitable for return for health protection or hygiene reasons once their seal has been removed after delivery, such as opened pet food, treats or care products. It also does not apply to items that have been made to your personal specifications.

We recommend sending returns with a tracked service, as we cannot take responsibility for parcels that are lost on their way back to us.

12. DAMAGED, FAULTY OR INCORRECT ITEMS

If your order arrives damaged, faulty or is not what you ordered, please contact us at info@beritajadul.com and include your order number and a few photos if possible. We will sort it out quickly with a replacement, a repair or a refund, depending on what makes the most sense and what you prefer within your legal rights.

Your statutory warranty rights for defects apply in full. For new goods, the legal warranty period is two years from delivery.

13. RETENTION OF TITLE

The goods remain our property until they have been paid for in full.

14. SOCIAL MEDIA

You may find us on social media platforms. These platforms are run by other companies and have their own terms and privacy rules. Comments and opinions posted by other users on our pages are their own and do not necessarily reflect our views. If you see something offensive or inappropriate, please report it using the tools of the platform concerned.

15. REVIEWS, PHOTOS AND OTHER SUBMISSIONS

We love hearing from you and seeing photos of your pets with our products. When you send us or post reviews, photos, comments, ideas or suggestions, you confirm that the content is genuine, that you own the rights to it and that it does not infringe the rights of anyone else.

By submitting such content, you give us a free, non exclusive right to use, show and publish it on our website, in our newsletters and on our social media channels, together with your first name or username if you agree to this. We will never publish your full name or contact details without your permission. You can ask us at any time to remove content you have shared with us.

Reviews and customer photos reflect the personal experience of individual customers and may not be typical for every pet or every situation.

16. INTELLECTUAL PROPERTY

All content on beritajadul.com, including texts, photos, graphics, logos, product descriptions and the design of the website, belongs to us or to our licensors and is protected by copyright and other intellectual property laws.

You may view, download and print content from our website for your own private use only. You may not copy, sell, distribute, publish or otherwise use any part of our website or its content for commercial purposes without our prior written permission. You may also not mirror our website on another server or use our name or logo without our consent.

If you believe that content on our website infringes your rights, please contact us at info@beritajadul.com with a description of the content concerned and why you think it infringes your rights. We will look into it promptly and remove the content if necessary.

17. THIRD PARTY WEBSITES AND LINKS

Our website may contain links to other websites or content from other providers. We have no control over these and are not responsible for their content, products or privacy practices. Please read their terms and policies before using them. Any questions or complaints about third party products or services should be directed to the provider concerned.

18. LIABILITY

We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.

For slight negligence, we are only liable if we breach an essential contractual obligation, meaning an obligation that makes the proper performance of the contract possible in the first place and on which you can normally rely. In that case, our liability is limited to the typical damage that could be foreseen when the contract was made.

Otherwise, our liability is excluded to the extent permitted by law. These limitations also apply to our employees, representatives and agents.

We work hard to keep our website available and secure, but we cannot guarantee that it will always be available without interruption or completely free from errors.

19. ELECTRONIC COMMUNICATION

You agree that we may contact you by email about your orders and your use of our website. Notices, confirmations and other information we send you electronically count as being in writing.

If you sign up for our newsletter, we will only send you marketing emails with your consent. You can unsubscribe at any time using the link at the bottom of every email.

20. GOVERNING LAW AND DISPUTE RESOLUTION

These terms and all contracts concluded through beritajadul.com are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. As a consumer living in the Netherlands, you keep the protection of any mandatory consumer laws of the Netherlands that apply to you.

If you have a complaint, please get in touch with us first at info@beritajadul.com. Most issues can be solved quickly and personally.

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

21. SEVERABILITY

If any part of these terms is found to be invalid or unenforceable, the remaining parts will still apply in full. The invalid part will be replaced by the statutory rules.

22. CHANGES TO THESE TERMS

We may update these terms from time to time. Changes will be published on this page and do not affect orders that were placed before the change.
